COMPETITION DETAILS

Head On Foundation Ltd and Oliver Lang and Misho Baranovic, together known as “Mobile Photo Network” (Organisers) invite photographers to submit images taken on a smartphone, tablet or smart camera (Mobile Devices) of backyards as part of a competition (Competition) to be shown in the Backyard Exhibition at Superintendent’s Residence, Centennial Park between 17 May and 23 June 2013 (Exhibition).

Purchasing this product will give you one entry into the Competition. After adding this to your cart, you will be asked to upload your photographs as part of your entry. The entry fee is $10 per entry (inclusive of GST) which includes up to 5 photographs.

The Organisers are not responsible or liable for any data loss or corruption to your photographs which may occur during the submission process. After paying for the entry, you will not be able to modify your photographs.

SELECTION CRITERIA

Up to 30 of the best images as determined by or on behalf of the Organisers will be selected for the Exhibition. All images must be taken on a Mobile Device.

The Organisers will judge the Competition entries.

TERMS AND CONDITIONS

Any individual in Australia or outside of Australia (no companies) may enter their work in the Competition. If you are under 18 years old, please obtain permission from your parent or legal guardian to enter the Competition.
You may submit as many entries as you wish. The entry fee for 1 entry is $10 (inclusive of GST) and permits you to submit up to 5 photographs to the Competition (Images).
You may only enter the Competition by submitting the Images online via mobilephotonetwork.com/backyard and paying the entry fee via the secure payment gate. Please retain your payment receipt details and print a copy of the receipt as no other tax invoice will be issued. You will be contracting with Head On Foundation Ltd (A.B.N. 46 127 619 149).
The entry fee of $10 per entry is non-refundable. Any entry not accompanied by payment will not be eligible for the Competition.
The deadline for submission of entries is Midnight Thursday 2 May 2013 (EST).
Subject to conditions 7 and 8, you will retain all copyright and any other intellectual property rights in the Images.
By submitting your Images to the Competition:
1. you, to the extent permitted by law, irrevocably and unconditionally consent to the Organisers’ acts or omissions in relation to your moral rights and rights in the nature of moral rights in the Images which may or might otherwise constitute a breach or infringement of those moral rights and waive your moral rights and rights in the nature of moral rights in the Images; and
2. you agree that, without limitation, the Organisers have the unlimited right to alter and/or use the Images for the purposes set out in this Agreement and you will not permit, support, commence or maintain any action or proceeding on the ground that any version of the Images infringes any of your moral rights or rights in the nature of moral rights.
If you are selected as a finalist:
1. you also grant Head On Foundation and Mobile Photo Network a non-exclusive, worldwide, royalty-free licence to use, reproduce, publish, distribute and communicate the Image(s) solely for the purposes of hosting and selling printed Image(s) at the Exhibition and for exhibiting the printed Images at future shows held by Head On Foundation;
2. you agree that the Organisers may sell the printed version of the Image(s) during the Exhibition at prices to be agreed with you. You will receive 50% of the GST exclusive amount received for any sold prints; and
3. you agree that any of your printed Images which are not sold during the Exhibition will be kept by Head On Foundation for a period of 5 years from the closing date of the Exhibition and may be exhibited in shows which are held by Head On Foundation during that time. At the end of this period any remaining prints will be destroyed.
The finalists will be advised by email by Monday 6 May 2013 [EST]. Unsuccessful entrants will not be contacted. The Organisers may decide to publish the results of the Competition. If so, this will be done in accordance with the Privacy Statement below.
The winning entries will be exhibited between 17 May – 23 June 2013 at Superintendent’s Residence, Centennial Park.
The Organisers will not be responsible for any loss or damage to your Images whilst in the Organisers’ custody or in transit or when the Images are being transferred or reproduced by any means including digital copying, printing, and on-line transmission.
The selection panel’s decision is final and no correspondence will be entered into.
By submitting your Images to the Competition, you agree to the Organisers accessing and using your personal information that you disclose to us, including as part of the entry form, subject to the Privacy Statement below.
By submitting your Images to the Competition, you warrant that:
1. you are the sole creator and owner of the Images you have submitted;
2. if relevant, you have the permission of the subject/s, or where a subject is under 18 years old or if otherwise appropriate, the subject’s parent or legal guardian;
3. if you are under 18 years old, you have obtained your parent or legal guardian’s permission to enter the Competition;
4. the Images do not infringe any third party’s intellectual property rights;
5. the Images were not taken by trespassing on anyone’s property or invading anyone’s privacy;
6. you have complied with all applicable laws, regulations and codes and obtained all necessary releases to submit your Images to the Competition;
7. the Images are not defamatory; and
8. you took the Images on a Mobile Device.

PRIVACY STATEMENT

Head On and Mobile Photo Network (“we”, “us“) recognise the importance of your privacy, and that you have a right to control how your personal information is collected and used. All personal information about you will only be collected, processed and used in accordance with applicable laws. Unless you directly give us consent to do otherwise, we will only collect and use your personal information as set out below.

Collection and holding of personal information

We may collect and hold personal information about you, including, for example, details you provide in entering the Competition, your contact details (such as email address, name, address and phone number), and where necessary to effect a purchase, return, payment or similar transaction, your credit card, PayPal or banking details. We will only collect and hold this information as reasonably necessary for our functions or activities.

If you do not provide us with the requested personal information, you will not be able to participate in the Competition.

Security of personal information

We will endeavour to take all reasonable steps to keep secure any information which we hold about you, and to keep this information accurate and up to date. Your information is stored on secure servers that are protected in controlled facilities. We require our employees and data processors to respect the confidentiality of any personal information held by us.

In respect of all online dealings, however, unfortunately, no data transmission over the internet can be absolutely guaranteed to be secure. As a result, while we strive to protect your personal information, we cannot guarantee the security of any information you transmit to us through our Website and you use our Website at your own risk.

Use of personal information

We may use personal information you have provided to us, including your email address, in connection with the Competition (e.g. we may use and publish your information if your Images are published), to provide you with information in relation to our new or updated products or services, special offers, promotions or competitions or other activities that you may be interested in.

If at any time you do not wish to receive such information from us, you may ask us to remove your name from our list by emailing us at mobilephotonetwork@gmail.com. Alternatively, if we send you such information by email, you can use the unsubscribe function in the email to inform us that you do not wish to receive such information from us by email. In either case, please allow 5 business days for your request to be processed.

Disclosing your personal information

In order to run our business efficiently, improve and provide our products and services to you, respond to your queries and/or send you information about future products, services and/or activities that you may be interested in, your personal information may be disclosed to our service providers (eg. independent contractors and consultants, printers, off-site security storage providers, website hosts, mail-houses, electronic database managers, event managers, credit managers and debt collecting agencies).
